§ 31.20 Organization and Appointment
(excluding Hutchinson Utilities Commission)

All board and commission appointments authorized by ordinance or resolution shall be made by the Mayor, and each appointment confirmed by the Council. The term of each appointee shall be established and stated at the time of his or her appointment.
Except for the Economic Development Authority, no board or commission member shall be appointed to more than two consecutive full terms, exclusive of the fulfillment of an unexpired term or partial term previously served, but shall again be eligible for service following a break in service of not less than one year.
New appointees shall assume office on the first day of the first month following their appointment and qualification, or on the first day of the first month following the expiration of the prior term and qualification, whichever shall occur last. Provided, however, that all appointees to boards and commissions shall hold office until their successor is appointed and qualified. All vacancies shall be filled in the same manner as for an expired term, but the appointment shall be only for the unexpired term. All appointed board and commission members shall serve without remuneration, but may be reimbursed for out-of-pocket expenses incurred in the performance of their duties when those expenses have been authorized by the Council before they were incurred. The chair and the secretary shall be chosen from and by the board or commission membership annually to serve for one year. Provided, however, that no chair shall be elected who has not completed at least one year as a member of the board or commission. Any board or commission member may be removed by a four-fifths majority vote of the Council for misfeasance, malfeasance or nonfeasance in office and his or her position filled as any other vacancy. Each board and commission shall hold its regular meeting at a time established by it. Except as otherwise provided, this section shall apply to all boards and commissions. All ex-officio members to city boards and commissions shall be non-voting members of the board or commission.
Airport Commission
The Airport Commission meets at the call of the Chairman. All meetings are held in the Airport Conference Room. The Airport Commission shall be composed of six members to serve staggered three-year terms, one of which shall be a member of the Council designated by the Council. The Commission shall advise the Council in all matters dealing with the airport and its operation. It shall recommend an annual operating budget, report on the adequacy of facilities, recommend capital improvements and serve as a forum for others to express their views on subjects relating to the airport and its operation.

Bicycle/Pedestrian Advisory Committee
The Hutchinson Bicycle-Pedestrian Advisory Committee (BPAC) meets at 3:00 pm quarterly, at various locations. The BPAC serves as an advisory committee to the City Council and the Park, Recreation and Community Education Board. The BPAC provides advice on issues related to bicycling and pedestrian needs in Hutchinson, advocates for pedestrian and bicycling infrastructure improvements, and promotes recreational walking and bicycling in the city.

Economic Development Authority
The EDA Board meets at noon on the fourth Wednesday of the month at Enterprise Center. The Board consists of seven commissioners, two of whom must be members of the City Council and five who are members of the Community. Appointments to the EDA are made by the Mayor and approved by the City Council and board members serve staggered six year terms. The EDA works to promote the continued growth and development of the community of Hutchinson, in partnership with the City and the Chamber of Commerce.

The Library Board meets at 4:30 p.m. on the 4th Monday of the month at the Library. The Library Board shall consist of seven members, six of whom shall be residents of the city and serve staggered three-year terms and one of whom shall be a member of the Council and designated by the Council.

Parks/Recreation/Community Education Board
The PRCE Board meets at 5:15 pm on the first Monday of the month at various locations. The PRCE Board shall be composed of seven representatives from the community at large, one representative from the School Board, and one representative from the City Council. With the exception of the School Board and City Council representative, all members shall be jointly appointed by the Mayor and the School Board President, with the consent of the respective boards and Council, and shall serve staggered three-year terms. The Board shall study and determine the park, recreational and community education needs of the city and make recommendations to the City Administrator relating thereto and shall submit an annual operating budget to the City Administrator.

Planning Commission
The Planning Commission meets at 5:30 pm on the third Tuesday of the month at the City Center. The Planning Commission shall be composed of seven members of which six shall be residents of the city, but not members of a public body, who shall serve staggered five-year terms, and one member of the Council shall be appointed by the Mayor to serve terms expiring on March 31 of each year. The City Attorney shall be an ex-officio member. The Planning Commission shall have all the powers and duties defined or granted in the state statutes and the city code relating to planning, zoning and subdivision regulation and shall act in an advisory capacity to the Council in all of these areas.

Police Civil Service Commission
The Police Commission meets the 2nd Tuesday of the month at 4:45 pm at the Police Department. The Commission consists of three members whom shall be residents of the City and serve staggered three-year terms. The Commission supervises the hiring, promotion, discharge, and suspension of all officers and employees of the Police Department of the City of Hutchinson and these powers shall extend to and include all members of the Police Department (MN Statute 419.05)

Public Arts Commission
The Public Arts Commission shall be composed of seven members, six of whom shall serve staggered three-year terms and one of whom shall be a member of the City Council. Commission members shall be appointed by the Mayor with Council approval. The Director of Planning/Zoning/ Building and the Director of Parks/Recreation/Community Education shall be ex officio members. The Public Arts Commission shall act in an advisory capacity to the City Council for the city and shall make recommendations to the City Council on issues regarding public art within the city limits. The Public Arts Commission may develop and implement policies and procedures, as necessary, with approval by the City Council, to meet the purpose and objectives of the Commission. The Public Arts Commission shall review all projects that meet specific criteria in accordance with its written Policies and Procedures. Commission Members:

Senior Advisory Board
The Senior Advisory Board meets at 9:30 am on the third Monday of the month at the Senior Center. The Board consists of seven members who serve staggered three year terms. The board shall advise the PRCE Board and staff concerning management and use of the multi-purpose senior center, and shall develop and maintain a management plan which provides opportunity for all senior-related activities to flourish.

Sustainability Advisory Board
The Sustainability Advisory Board consists of up to five members who are appointed by the Mayor, subject to ratification by the City Council. One of the board members shall be a Hutchinson City Council Member and, additionally, one of the board members may be a member of the Hutchinson Utilities Commission. All remaining board members are “at-large” members. One at-large member may be a non-resident of the city of Hutchinson. At-large members shall serve staggered three-year terms. The Board will advise and make recommendations to the City Council and identify the highest priorities for city government and citizens to achieve sustainable management of natural resources – water, urban forests, and energy in particular – and shall recommend to the City Council goals to achieve and workable means to reach such goals; provide input to the City Council and city staff as to the continued use and environmentally-friendly manufacturing of compost and other products produced at Creekside Soils, the recommendations as to tree management, including amendments to the Hutchinson City Code; advise the City Council as to resource and energy reduction measures in city buildings and operations; promote the City’s continued participation in programs such as Tree City USA, GreenStep Cities, and the SolSmart Designation.

Utilities Commission
The Hutchinson Utilities Commission meets at 3:00 pm on the last Wednesday of the month at the Hutchinson Utilities Office. The Utilities Commission shall consist of five (5) persons, registered voters of Hutchinson, who shall be appointed by the council. One of the members may be a member of the city council appointed annually by the mayor with the consent of the city council, at the first meeting of the city council in January of each year. After initial appointments for such terms as are set by the council, a member shall be appointed every year for a term of 5 years, to fill the place of the member whose term has expired, except for any city council member appointed to serve on the Utilities Commission, and in such case, that person shall serve a one year term subject to reappointment. The commissioners in office at the time of adoption of this charter shall continue to serve the term to which they were previously appointed. Commissioners shall qualify for their office by taking and subscribing to the oath of office required of members of the council and filing the same with city administrator. They shall hold office until their successors are appointed and qualified and vacancies in office for any cause shall be filled for the balance of the term in which the vacancy occurs in the same manner as the original appointment is made. No member shall serve more than two consecutive five-year terms, exclusive of the fulfillment of an unexpired term, but shall be again eligible for such service following a break in service of not less than one year. The members of the commission, excluding the city council member, may receive compensation for their services as determined by the council.
